- When you interact with our advertising and applications (including mobile apps) on third-party websites and services, if those applications or advertising include links to this policy.

We may provide additional or different privacy policies that are specific to certain features, services, or activities.
Our Privacy Policy outlines how we process personal information, including business contact information and other types of personal information that are submitted to us through our Services or otherwise collected, stored, used, disclosed, inferred, acquired or processed by us in connection with developing, improving or providing our Services. Our Privacy Policy also describes our practices for collecting, storing, using, disclosing, and otherwise processing personal information in relation to visitors to our Website, and Users use and access of our Services. We may provide additional or different privacy policies that are specific to certain features, services, or activities.
Our Users can obtain information and utilize our Services for purposes such as data enrichment, marketing, and sales activities.

1. Children's and Minors' Data
Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 18. If we learn we have collected or received personal data from a child under 18 years old without verification of parental consent, we will delete that information.
2. The Personal Data That We Collect or Process
"Personal data" is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, or payment information (for example, account information such as name, postal address, and email address, credit card number).
The types and categories of personal data we collect or process include:
- Account and contact information, including name, address (such as home address, work address, or other address), email address, phone number, username, and other contact information you provide us.

- Account history, including information about your subscription, account, transactions, purchases, order history, or discounts.
- Demographic information, including your age, gender, income level, education, or family or marital status.
- Location information, including general geographic location such as country, state or province, or city and precise geolocation.
- Device information, including your IP address, device identifiers, operating system and version, preferred language, hardware identifiers, browser type and settings, and other device information.
- Content and information you elect to provide as part of your profile or in any reviews you make through the Services or surveys you submit to us or emails, chats, or other communications sent to us.
Some of the information identified above, including precise geolocation information may be considered sensitive data under certain laws. If required under applicable law, we will collect and process sensitive personal data only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, services, or information.
We also collect:
- Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific Services feature.
- Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.
If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.
3. How We Collect Your Personal and Other Data
a. You Provide Information to Us
We collect information about you when you interact with our Services, such as when you create or update an account, place an order, subscribe, make a request, participate in surveys, contests, or promotions, or create, upload, or post content to the Services, including reviews, leads lists, media such as photos, videos, or audio recordings.
Our Users may provide a variety of information to us by using our Services including, but not limited to:
- Users’ own contact and other personal information, such as name, email address, telephone number, job title, employer and location.
- Information about our Users' business contacts, such as their contacts list or customer list; including for instance, name, email address, telephone number, job title, employer and location.
- Other personal information, such as website visitor IP addresses, that our Users’ submit to us through their use of our Services.
When Users submit data to ListKit through the Services, they acknowledge and agree that ListKit may use such information to grow, enrich, and verify the information included in our database, which is made available to other ListKit Users as part of our Services. This means that the information they provide to ListKit may be used to enhance the quality, accuracy, and completeness of the data available to all Users of the ListKit platform.
b. Automatically Through Our Services
As you navigate through and interact with our Services, we may use automatic data collection technologies to collect information that may include personal data. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies, web beacons, and other tracking technologies including details of your interactions with our Services, such as traffic data, location data, logs, and other communication data, and which resources and Services features that you access and use.
We may use these automatic collection technologies to collect information about your online activities over time and across third-party sites or other online services (behavioral tracking).
Using automatic collection technologies helps us to improve our Services and to deliver a better and more personalized experience.
The technologies we use for this automatic data collection may include:
- Cookies. A cookie is a small file placed on your device when you interact with the Services. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Services.
- Web Beacons. Some parts of the Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those parts or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).
- Google APIs. ListKit integrates with Google APIs, including Google Workspace APIs, to provide its services. Information collected through these APIs is used and transferred in accordance with the Google API Services User Data Policy.
- Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
- Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
To the extent any of these automated technologies are considered a personal data sale, targeted advertising, or profiling, under applicable laws, depending on where you live, you may opt out from use of these automated technologies for such uses by submitting a data subject access request or contact us at hello@listkit.io. Please note that some Services features may be unavailable as a result.
When you interact with the Services, there are third parties that may use automatic collection technologies to collect information about your or your device. These third parties include:
- Advertisers, ad networks, and ad servers.
- Analytics companies.
- Your device manufacturer.
- Your internet or mobile service provider.
These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your personal data or they may collect information, including personal data, about your online activities over time and across different websites, apps, platforms, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
c. From Users, Business Partners and Service Providers
We may receive personal data about you from other sources and combine that with information we collect directly from you. For example, we may obtain information about you from service providers that we engage to perform services on our behalf, such as email platform providers, content delivery services, payment processors, analytics, security and anti-fraud services, and data brokers. We also may receive personal data from business partners or affiliates that we engage to share consumer information with us, including your personal preferences and demographic information such as age, gender, and income level so that we can better provide you with a personalized experience, including personalized content, offers and services. We may also obtain information from our Users when they upload or provide certain information such as connecting their customer relationship management or uploading a CSV for using our Services.
We collect certain personal information from data providers, such as professional contact details, job title and information about your company or employer, to allow our Users to run queries on the data as part of our Services. We may receive data from data enrichment providers to enhance the information in the databases ListKit obtains from its data providers.
4. How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal data, to:
- Provide you with the Services and any contents, features, information, products, or services that we make available through the Services.
- Fulfill and manage subscriptions, purchases, orders, and payments.
- Fulfill any other purpose for which you provide it.
- Provide you with notices about your subscription, including expiration and renewal notices.
- Improve our Services, including by analyzing your information and creating aggregated data derived from your information) to develop, maintain, analyze, improve, optimize, measure, and report on our Services and their features and how users interact with them. Our analysis may include the use of technology like machine learning and large language models, which may include training these models or sharing with third parties for model training.
- Promote our Services, business, and offerings by publishing advertising on our own Services and by placing ads on third parties' services. We may use your information to model, segment, target, offer, market, and advertise our Services.
- Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
- Notify you when Services updates are available and about changes to any products or services we offer or provide though them.
- In any other way we may describe when you provide the information.
- To provide Services to our Users.
The usage information we collect, whether connected to your personal data or not, helps us improve our Services and deliver a better and more personalized experience by enabling us to:
- Estimate our audience sizes and usage patterns.
- Store information about your preferences, allowing us to customize the Services according to your individual needs and interests.
- Speed up your searches.

We will respond to any requests received in a timely manner pursuant to the applicable State Privacy Laws.
By remaining in our database, you may be contacted by our Users when they are conducting their business-to-business sales and marketing activities. Communications you receive from our Users may be relevant to your profession or employment role, but we cannot guarantee that you will find such communications to be relevant or of interest to you. ListKit is not liable nor responsible for actions taken by our Users who utilize our Services.
5. Who We Disclose Your Information To
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
We may also disclose personal data that we collect or you provide as described in this privacy policy:
- To our subsidiaries and affiliates.
- To contractors, service providers, and other third parties we use to support our organization.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of ListKit LLC's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by ListKit LLC is among the assets transferred.
- To fulfill the purpose for which you provide it. For example, if you give us an email address to use the "email a friend" feature of our Services, we will transmit the contents of that email and your email address to the recipients.
- For any other purpose disclosed by us when you provide the information.
- If your information is present in the databases that ListKit obtains from its data providers, we may disclose your personal information to our Users when they run queries on our databases.
- We may also disclose your information in other cases with your permission.
We may also disclose your personal data:
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- To enforce or apply our terms of use and other agreements, including for billing and collection purposes.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our organization, our Users, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
6. Your Rights and Choices About Your Information
This section describes mechanisms you can use to control certain uses and disclosures of your information and rights you may have under state law, depending on where you live.
Advertising, marketing, cookies, and other tracking technologies choices:
- Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. If you disable or refuse cookies or similar tracking files, some Services features may be inaccessible or not function properly. You can also opt out by logging into your account and adjusting your account settings and preferences or sending us an email stating your request to hello@listkit.io.
- Targeted Advertising by the Company. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target audience preferences, you can opt out by submit a data subject access request or contact us at hello@listkit.io.
- Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal data with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt out by submit a data subject access request or contact us at hello@listkit.io. You can also opt out by logging into your account and adjusting your account settings and preferences or sending us an email stating your request to hello@listkit.io. We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Location data choices:
- Location Data. You can choose whether or not to allow the Services to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, some Services features may become inaccessible or not function properly.
7. Your State Privacy Rights
Depending on your state of residency, you may have certain rights related to your personal data which we address further in our Privacy Statement, including:
- Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible and required by state law, depending on your state, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information and it will be included in the response to your access request.
- Correction. You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information's nature and processing purpose.
- Deletion. You may request that we delete personal data about you that we maintain, subject to certain exception under applicable law.
- Opt Out of Using Personal Data for Targeted Advertising, Profiling, and Sales. You may request that we do not use your personal data for these purposes.
Important: The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request.

Some browsers and browser extensions support the Global Privacy Control ("GPC") that can send a signal to process your request to opt out from certain types of data processing, including data "sales" as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

8. Your Privacy Rights Outside the United States
We process your information for our legitimate business purposes, such as to provide you or our Users with our Services, to develop and improve our Services, or for compliance with our legal obligations. If you are located in the European Economic Area, the United Kingdom, or Switzerland (“Europe”), we only process your personal information based on a valid legal ground. A “legal ground” is a reason that justifies our use of your personal information:

- Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.

We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to:
- Send users information about special offers and discounts on our products and services
- Develop and display personalized and relevant advertising content for our users
- Analyze how our Services are used so we can improve them to engage and retain users

If we are relying on your consent to process your personal data, you have the right to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any personal data processing prior to such withdrawal, nor will it affect any personal data processing that we undertake in reliance on legal bases other than consent (such as legitimate interests).
In some cases, we may act as a processor for our Users. In cases where we act as a processor, you should direct any requests to exercise your data protection rights to the relevant User of our Service, not to us. We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:
- If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
- For investigations and fraud detection and prevention
- For business transactions provided certain conditions are met
- If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim
- For identifying injured, ill, or deceased persons and communicating with next of kin
- If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse
- If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province
- If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records
- If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced

9. Social Logins
Our Services offer you the ability to register and log in using your third-party social media or Google account details (like your Google login). Where you choose to do this, we will receive certain profile information about you from your social media provider or Google. The profile information we receive may vary depending on the provider concerned, but will often include your name, email address, and profile picture, as well as other information you choose to make public on such a platform.
We will use the information we receive only for the purposes that are described in this privacy notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party providers. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.
ListKit integrates with Google APIs, including Google Workspace APIs, for the provision of certain services. We ensure that our use of these APIs complies with the Google API Services User Data Policy, including the Limited Use requirements.
10. How We Protect Your Personal Data
We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal data is at your own risk.
The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.
11. How We Retain Your Personal Data
We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. The data we process in providing the Service is non-sensitive personal data and not subject to any sector specific data retention requirements. We retain such personal data for as long as it is useful in our Services, either as an actual data point or in order to derive, correct or validate other data points, and provided that we are comfortable that the data is accurate and can be relied upon.
We delete personal data when either (i.) it is no longer used for any purposes, or (ii.) a data subject requests deletion of their personal data or objects to us processing their data pursuant to their GDPR or other state or national rights (unless we have a valid legal justification to retain it, such as to resolve disputes or comply with our legal obligations).
